General Terms and Conditions for Booking and Use
Boat Rentals, Experiences, and Maritime Events
1. Legal Notice and Provider Information
The website is owned by CATVENTS, S.L. (hereinafter, the “Provider”), with Tax ID B64392897, registered office at Riera de la Creu 39, A 3 1, 08901 L’Hospitalet de Llobregat (Barcelona), and contact email info@catvents.com.
These conditions regulate the access, navigation, and use of the website, as well as the booking of boat rental services and maritime event organization offered by the Provider.
2. Purpose and Scope of Service
The Provider offers boat rental services — including sailboats, catamarans, and yachts — with or without crew, as well as the management of onboard experiences and events, including corporate celebrations, birthdays, and bachelor/bachelorette parties.
The dates, times, vessel, port, duration, included services, and price will be those stated in the quote, booking form, or specific contract accepted by the client.
3. General Conditions for Service Provision.
- The Provider agrees to lease the vessel and provide the service on the days and times specified in the booking form, proforma invoice, or contract.
- The vessel will be delivered with a crew when applicable, clean, ready to sail, with the equipment indicated in the catalog, and in safety conditions appropriate to its category, at the agreed port.
- In the case of Day Charter or hourly rentals, if the vessel cannot be delivered on time and day, the Provider will make reasonable efforts to deliver the vessel on the agreed date, time, and location. A pro-rata refund will be agreed upon for each full 30-minute period of delay. If the delay exceeds 25% of the total rental period, the client may cancel the agreement and recover the amount paid for the rental, without prejudice to their legally corresponding rights. If the vessel is used in port, it will be considered that the service has begun, as the client is using the boat’s spaces and consuming agreed-upon beverages.
- In the event of attention or a requirement from authorities during the service, authorities may inspect the vessel and keep it blocked in port during the inspection. Any reimbursement for the time spent on such inspections and derived expenses is excluded; this clause is subject to applicable mandatory regulations.
- The rental time begins at the agreed hour. Delays attributable to clients will not extend the planned duration of the navigation.
- The Provider will not be responsible for the impossibility of providing the service due to meteorological causes when navigation is not safe, applying the weather policy of these conditions (Section 5) and current regulations.
4. Request, Booking Confirmation, and Payments
- Requests and quotes can be processed through the website, contact form, email, WhatsApp, phone, or any other written means. All bookings are subject to vessel and crew availability.
- To confirm the booking, the client must pay an initial deposit of 50% of the total service amount. The booking will not be considered formalized until this payment is received.
- If the booking is confirmed 15 calendar days or less before the service date, the total service amount must be paid.
- For Day Charter services, the provided document states that the remaining 50%, along with additional services, must be paid 7 days before the event. The website also allows for the balance to be paid on the same day, before casting off, when stipulated in the specific contract. The applicable payment method must be expressly indicated in the quote or contract.
- When applicable, for bareboat charters or certain events, a security deposit of up to €5,500 (depending on the boat’s characteristics) may be required. Its return will be made after the trip and once the vessel’s condition has been checked, in accordance with the particular conditions of the booking.
The Provider will be obliged to comply with the contract conditions provided that the client has made payments within the agreed deadlines.
5. Cancellations and Modifications by the Client
5.1. Day Charter Cancellation — Document Policy
Any cancellation will incur a cost of 5% (+ VAT) of the total quote or invoice for booking management and bank fees. (An invoice will be issued for this expense).
- Up to 30 days before the event: refund of the amount paid. (-5% +VAT)
- Between 15 and 29 days before the event: 50% refund. (-5% +VAT)
- Between 3 and 14 days before the event: 30% refund. (-5% +VAT)
- Within 48 hours before the event: no refund of the amount paid.
- Cancellations will not be accepted once the service has begun.
5.2. Catering, Extras, and Third-Party Services
– Catering or beverage booking services must be confirmed and paid at least 15 days before the event. Food allergies and intolerances must be communicated in writing in advance.
– Cancellations or reductions of catering services made within 48 hours before the event date and time will be charged at 100%.
– Services booked with external providers or third parties — such as musicians, golf, port spaces, activities, or other professionals — will be subject to each provider’s cancellation policy.
– Amounts for banners, flags, t-shirts, clothing, or other personalized products with a manufacturing lead time incompatible with cancellation will not be refunded.
6. Cancellation Due to Weather and Sea Conditions
Safety prevails over service execution. The decision to cancel or modify the route due to weather or sea conditions rests exclusively with the Captain/Skipper or the Barcelona Maritime Authority.
- 48 hours before the start of the service, the weather forecast will be reviewed. If bad sea conditions are predicted, a date change or cancellation may be proposed.
- If cancellation due to weather conditions prevents safe navigation, an alternative date or time will be offered first. If it is not possible to agree on the change, a refund of the total invoice amount will be made, excluding management costs and services already consumed or non-cancellable personalized extras.
- Given a possible bad forecast 48 hours in advance, a decision can be made regarding catering and extras for their refund, excluding cancellation fees contemplated by the provider.
- Light rain or the presence of clouds will not, by themselves, prevent the activity if sea conditions allow for safe navigation. Bad conditions are understood as those that endanger navigation, guests, or the crew.
Weather forecasts are indicative and may vary from actual conditions. The Provider may inform and advise cancellation when it considers that conditions are not suitable for the safety and enjoyment of clients.
7. Capacity, Conduct, and Onboard Rules
- The number of passengers, including minors, may under no circumstances exceed the maximum legal capacity authorized for the booked vessel.
- The Captain/Skipper is the highest authority on board. All passengers must follow their instructions, especially regarding maritime safety.
- The use of illegal substances, reckless behavior, and any state of intoxication that endangers the safety of the vessel or its occupants are prohibited. In case of non-compliance, the Skipper may take necessary safety measures, including ending the event and returning to port.
- The economic consequences will be applied in accordance with the contract and current regulations.
- The client agrees that no person on board will perform acts contrary to Spanish laws. Unlawful conduct may lead to the interruption of the service and communication to the competent authorities.
8. Complementary Services, Catering, and Vessel Use
- Catering, beverage, DJ, music, decoration, and other extra services must be confirmed and paid within the deadlines indicated in the quote or contract; the website sets a minimum of 15 days before the event as a reference.
- The client must communicate any food allergies or intolerances in writing and in advance.
- Products or objects that could damage the deck, upholstery, or equipment — for example, high-heeled shoes, red wine in upholstered areas, or pyrotechnics — may not be used unless expressly authorized.
- Third-party services and personalized products may have their own cancellation conditions, which must be communicated to the client before booking.
9. Liability, Damages, and Personal Items
The client will be liable for damages or defects caused to the vessel or its equipment due to improper use, negligence, or non-compliance with safety instructions, to the extent legally applicable.
The Provider does not assume custody of personal items and will not be responsible for losses, thefts, or damages suffered by them on board or in port facilities, except in cases where the law establishes liability.
Insurance coverage does not extend to losses or damages to personal effects of the client or their guests. This provision is without prejudice to liabilities that cannot be legally excluded.
10. Licenses and Insurance
The vessels offered have permits, registrations corresponding to their activity, licenses from the Maritime Authority, and civil liability and occupant accident insurance as required by Spanish legislation.
11. Bookings, Availability, and Operational Changes
Service provision is subject to vessel and crew availability. Any particular condition, change of schedule, port, route, included services, security deposit, or payment method must be stated in writing in the booking, quote, or contract accepted by the client.
12. Data Protection and Communications
Personal data provided by the client will be processed in accordance with the privacy policy published by the Provider and applicable regulations. This document does not replace the privacy policy, which must be consulted separately on the website.
13. Applicable Law and Dispute Resolution
These Terms and Conditions are governed by Spanish law. For the resolution of any conflict or dispute arising from the provision of the service, both parties submit to the Courts of the city of Barcelona, waiving any other jurisdiction that may correspond to them (without prejudice to consumer rights under current regulations).
14. Acceptance of Conditions
Confirmation of the booking and payment of the agreed amounts imply acceptance of the conditions communicated to the client, provided they have been made available before booking and without prejudice to the inalienable rights recognized by applicable legislation.
